Terms of service

Effective October 15, 2026

The short version

  • You own everything you record, and Documented never sees it.
  • We're not a law firm, we don't give legal advice, and we can't promise that an employer, agency or court will accept your record. That is always up to them, the rules that apply, and the facts.
  • Don't use the app to break the law or violate someone else's rights, including recording-consent laws where you live.
  • If a legal matter is on the line, talk to a licensed attorney where you live.

Agreement to these terms

These Terms of Service ("Terms") are a binding agreement between you and Documented ("we", "us", "our") governing your use of the Documented: At Work apps for iPhone and Android and this website (together, the "Service"). By downloading, opening, or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

If you got the app from the Apple App Store, Apple's Licensed Application End User License Agreement also applies. If the two conflict, these Terms apply to the extent the law allows.

Who can use Documented: At Work

You must be at least 18 years old and able to form a binding contract to use the Service. The Service is built for adults keeping a record of their own working life and is not directed at children.

What the app is, and isn't

Not legal advice

Documented: At Work is a record-keeping tool. Nothing in the app, the website, or any guide or export is legal advice, and using the Service does not create an attorney-client relationship. If you need legal advice about your job, a workplace complaint, or anything else, talk to a licensed attorney where you live.

No guarantee about how your record is used

We designed the app to produce a private, time-stamped, tamper-evident record, and features like RFC 3161 timestamps and export logs are meant to support that. But whether any entry, export or record is accepted by an employer, HR, an agency, an arbitrator or a court, and what weight it is given, is decided by them, the rules that apply, and the facts, not by us. We do not guarantee that any record created with the app will be accepted, admissible, or persuasive in any proceeding, in any jurisdiction.

Tamper-evident, not tamper-proof

"Tamper-evident" means a change made after an entry is sealed leaves a detectable trace. It does not mean a record can never be altered, lost, or disputed. Entries are sealed when you save them. Any change after that is recorded, never hidden. Sealing does not show that what an entry describes happened. Treat the app as one tool among several, not a substitute for your own judgment, your own notes, or your attorney's advice.

Your content

You own it

You own everything you create in the app: entries, photos, video, voice notes, scanned documents, message captures, locations, and exports. Because your content is stored on your device (and, if enabled, synced only to your own private iCloud account), we never receive it and claim no rights to it. If you switch on attorney sharing, we hold an encrypted copy we cannot read, only to deliver it to your attorney.

You're responsible for it

You're solely responsible for the content you create and for making sure you have the right to capture and keep it. This matters in particular if you record conversations, calls, voicemails or messages involving another person: recording-consent laws (sometimes called wiretapping or eavesdropping laws) vary by state and country, and some require every party's consent before you record a conversation. It also matters for confidential information that belongs to your employer or to customers, and for photos taken at work.

You agree to comply with the recording, privacy, employment and evidence laws that apply to you, and you agree not to use the Service to violate any court order or agreement, harass or stalk another person, or violate anyone else's legal rights.

Sharing and exports

Exporting or sharing an entry (including with HR, a union rep, an attorney, an agency, or anyone else) is entirely your choice and happens only when you start it. Once you share or export content outside the app, we have no control over what happens to it, and these Terms don't govern what the recipient does with it.

Accounts, storage and data loss

The app does not require an account. Your record lives on your device and, if you enable iCloud on iPhone, syncs to your own private iCloud account under Apple's terms. We don't operate servers that store your entries (apart from encrypted copies sent through attorney sharing, which we cannot read) and we can't recover them for you.

Because of this, you are responsible for keeping your device secure and for enabling iCloud or your own backup method. We are not responsible for content that is lost, corrupted, or made inaccessible because of a lost, stolen, reset, or damaged device, a disabled or unavailable iCloud account, an uninstalled app, or any failure of Apple's or Google's services.

Third-party services

The Service depends on services we don't control, including Apple (iOS, iCloud, the App Store), Google (Android, Google Play), the analytics, subscription and measurement providers described in our privacy policy, and an independent RFC 3161 timestamp authority used to timestamp sealed entries. We are not responsible for outages, changes, or failures of these third-party services, or for their own terms and policies, which apply to your use of them alongside these Terms.

Purchases and subscriptions

Some features need a paid subscription. It is billed and managed by Apple through your App Store account, or by Google through Google Play, under their own terms (including their subscription, auto-renewal and refund policies). We do not process payments or receive your payment details.

  • Prices are shown in the app before you buy. Payment is charged to your store account when you confirm the purchase.
  • If you start a free trial, you will be charged when the trial ends unless you cancel at least 24 hours before it ends.
  • Subscriptions renew automatically unless you turn off auto-renew at least 24 hours before the end of the current period. You can manage or cancel in your store account settings.
  • Cancellations and refund requests are handled through Apple or Google, not us.
  • If your subscription ends, your record stays on your phone.

Acceptable use

In addition to the restrictions above, you agree not to: reverse engineer, decompile, or attempt to extract the source code of the app except as permitted by law; resell, sublicense, or use the Service to build a competing product; interfere with or disrupt the Service or its infrastructure (including the timestamp authority); or use the Service for any unlawful purpose.

Intellectual property

The app, this website, and their design, text, graphics, logos, and software are owned by Documented or our licensors and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial purposes. All rights not expressly granted are reserved.

Additional terms for specific features

Some features (for example, tools built for attorneys) may come with additional terms specific to that feature. If those additional terms conflict with these Terms, the additional terms control for that feature only.

Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY RECORD CREATED WITH IT WILL BE SUFFICIENT, ACCEPTED, OR ADMISSIBLE FOR ANY LEGAL, EVIDENTIARY, EMPLOYMENT, OR OTHER PURPOSE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOCUMENTED WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, EMPLOYMENT, INCOME, OR OPPORTUNITY, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE (INCLUDING ANY RELIANCE ON A RECORD CREATED WITH THE APP IN A WORKPLACE, LEGAL, OR OTHER PROCEEDING) EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $100. SOME JURISDICTIONS DON'T ALLOW THESE LIMITATIONS, SO SOME OF THEM MAY NOT APPLY TO YOU.

Indemnification

You agree to defend, indemnify, and hold Documented harmless from any claim, damage, or expense (including reasonable attorneys' fees) arising from your content, your use of the Service, or your violation of these Terms or any law.

Termination

You may stop using the Service at any time by deleting the app. We may suspend or terminate your access to any account-based or shared features (such as attorney sharing) if we believe you've violated these Terms. Because your record lives on your device, termination of any such feature does not affect your ability to access content already stored locally or in your own iCloud.

Changes to these terms

We may update these Terms as the Service changes. If we make a material change, we'll update the effective date above and, where practical, note it prominently on this page or in the app. Continuing to use the Service after a change means you accept the updated Terms.

Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in California, and you and Documented each consent to personal jurisdiction and venue there. This does not take away any protections you have under the laws of the place you live.

General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision isn't a waiver of it. These Terms are the entire agreement between you and Documented regarding the Service and replace any earlier agreements about it.
